DESCRIPTION OF THE SERVICES
Those who have already reached the age of eighteen (18), or have reached the legal age to sign a binding contract in their own State can register as members of EPICO or use the Website and EPICO Service. If you are under the age of 18 or do not have the legal age set in your state, you can use the EPICO service only in conjunction with, and under the supervision of, a parent or legal guardian who has accepted the Terms of Service . By using the EPICO Website and / or Services, you represent and warrant that you have the right, authority and legal capacity to subscribe to these Terms of Service and to comply with all the Terms of Service provided therein.
CHANGES TO THE EPICO CONTRACT OR SERVICES
You agree and warrant that you understand that these Terms of Service, the Website and EPICO Services may be changed by EPICO at any time and without notice, and such changes will be effective as EPICO will post the new terms and / or since the new changes to the Website will be applied. You agree to periodically check the Terms of Service in order to be aware of any changes. Your continued use of the EPICO Service after any modification indicates your acceptance of the modified Terms of Service. Unless otherwise specified by EPICO, all new features, new services, improvements or changes to the EPICO Service applied following the user's first access to the Services will be subject to these Terms of Service.
USE BY THE USER
4.1 Registration and security In order to use or access EPICO Services, you may be required to register with EPICO by selecting a user name and password and entering your e-mail address ("User ID"). If the user decides to register, he agrees to provide EPICO with his personal information in an accurate, complete and up-to-date manner. Otherwise, it constitutes a violation of these Terms of Service, which may result in the immediate closure of your account. You may not: (i) enter, select or use a false name or e-mail address owned or controlled by another person with the intent to impersonate that person, or, (ii) use as a User ID a name subject to the rights of a person other than the user himself without prior authorization. EPICO reserves the right, at its discretion, to refuse or cancel the registration of a User ID. You are responsible for maintaining the confidentiality of your password and are fully responsible for all activities performed through your User ID and password. Any User ID and password provided for access to the EPICO Service are for personal use only. You agree to (a) immediately notify EPICO of any unauthorized use of your User ID or password, and (b) ensure that you log out of your account at the end of each session.
4.2 Content Under no circumstances will EPICO be liable in any way for the information, texts, sounds, photographs, graphics, videos, messages and other materials available through the Website and the EPICO Service (the "Content"), including any errors or omissions in any content, or any loss or damage of any kind arising from the use of any content. You are responsible for compliance with all laws applicable to the content you post on the Website. You agree to evaluate and assume all risks associated with the use of any content, including the subject, integrity, and the accuracy of the contents themselves. EPICO reserves the right to modify and delete links or content that will be deemed offensive and not compliant with these Terms of Service. EPICO also reserves the right to add or modify links sent by users with the distinctive signs of our commercial partners. Links sent by users with their own affiliation codes will be modified accordingly.
4.3 4.3 Content posted by users on the Website
1. You may not post, distribute, or reproduce in any way copyrighted material, trademarks, or other confidential information, without the prior written consent of the owner of such rights. 2. The user acknowledges and agrees that EPICO can control and delete any Content (such as links, images, profiles, comments, posts, messages) that at EPICO's sole discretion violates these Terms of Service or may be offensive, illegal, or that could violate the rights, damage or threaten the security of other users or members of the EPICO Site and / or users of other websites. 3. You are solely responsible for any Content you post or view on the Website or sent to other members and / or websites of other users (hereinafter the "Published Content"). 4. The user is solely responsible for his own evaluations and comments on the Website. EPICO reserves the right, but is not obliged, to monitor disputes between the user and any site he has published. 5. The user agrees to publish only Content which he considers to be true and agrees not to deliberately publish false or misleading information. 6. By publishing the Published Content on the Website, the user accepts and hereby declares and guarantees to have the right to grant EPICO, its contractors, and users of the Website a universal, irrevocable, perpetual, non-exclusive , without the right to any royalties, fully licensed license to use, copy, publicly and / or digitally transmit, and distribute such Published Content and to perform work related to them, or to incorporate the aforementioned Published Content into other works. 7. In case of development of social biography (more information available here [note to the Client: create a hyperlink to the page dedicated to the eStarbook]) the user gives EPICO a license on an exclusive basis to use the Published Content connected to the use of the EPICO Service and linked to the Website; 8. The following is a partial list of the type of Content and communications that are illegal or prohibited on / connected to the Website. EPICO reserves the right to examine and take appropriate legal action at its discretion against anyone who violates these provisions, including , without limitation, the removal of offensive communications from the EPICO Service, the cancellation of the registration of those who violate this provision and the right to block the use of the EPICO Service and / or the Website. The user cannot publish Content that : (a) are false or intentionally misleading; (b) are patently offensive to users of the Website, such as Content or messages that promote racism, fanaticism, hatred or physical threat of any kind against any group or individual; (c) are harassing or inciting harassment of another person; (d) involve the transmission of an unwanted mass mailing or "spamming"; (e) promote illegal activities or behavior deemed to be abusive; (f) they are threatening, obscene, defamatory or slander; (g) are pornographic or sexually explicit; and (h) propose or recommend material involving persons under the age of 18 in a sexual or violent manner, or propose or recommend persons under the age of 18 to disclose their personal data.
4.4 Limitations to the right of use The user cannot (and undertakes not to allow third parties to): (i) modify, adapt, translate, or reverse engineer any part of the Website and / or the EPICO Service;
(ii) remove any copyright, registered trademark or other proprietary rights contained in or on the EPICO Website and / or Service;
(iii) use any robot, spider, search / retrieval site, or other devices to retrieve or index parts of the Website and / or EPICO Service;
(iv) collect any type of information on other users or members (including usernames and / or e-mail addresses) for any purpose other than that provided for therein or sending and sharing with other EPICO users or members;
(v) reformat any part of the web pages that are part of the Website and / or of the EPICO Service;
(vi) create a user account through the use of automated or false or fraudulent means;
(vii) create or send unsolicited electronic communications such as "spam" to other users or members of the Website and / or the EPICO Service or otherwise interfere with the use by other users or members of the Website and / or the EPICO Service;
(viii) publish material or Content owned by third parties without the prior written consent of such third parties;
(ix) publish any Content or material that falsely declares or implies that such material or Content is sponsored or approved by EPICO;
(x) publish any Content or material that violates or abuses intellectual property rights, advertising, privacy or other proprietary rights of third parties;
(xi) transmit any viruses, worms, defects, Trojan horses or other elements of a destructive nature;
(xii) use the EPICO Website or Services for the purpose of violating the security of any computer network, decrypting passwords or security codes, transferring or storing illegal material including that deemed dangerous or obscene;
(xiii) copy or store any Content posted on the Website for any use other than that intended;
(xiv) publish illegal Content or materials that promote or encourage illegal activity;
(xv) publish false or misleading information for EPICO;
(xvi) to take any action that imposes, or may impose at EPICO's sole discretion, an unreasonable or disproportionate load on the IT infrastructure;
(xvii) use the Website and / or the EPICO Service, intentionally or otherwise, to violate any local, state, national or international law;
(xviii) collect or store personal data of other users in connection with the prohibited activities described in this paragraph.
INTELLECTUAL PROPERTY RIGHTS
We respect the intellectual property rights of third parties and ask our users to do the same. Our policy provides for the right to disable access or remove material that we believe legally violates the copyright of another work. We can also deactivate and / or terminate the accounts of users that we believe are legally violating copyright repeatedly.
5.1 Disputes relating to intellectual property rights
EPICO adopts the following general policy against copyright infringements pursuant to Legislative Decree n. 70/2003. Notifications regarding alleged copyright violations must be sent to the address shown below by the designated representative of EPICO (the "Designated Representative") email@example.com. EPICO's copyright policy is intended to (i) block access to or remove material that has been illegally copied and distributed by one of our members or users; and (ii) remove and terminate the service for those who repeatedly violate these rights.
5.2 Procedures for notification of copyright violations
If the user believes that the material or Content present or accessible through the Website or the Service violates a copyright, please send a notification to the Designated Representative regarding the copyright infringement containing the following information (the " Infringement Notification "): 1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner who is allegedly infringed; 2. The identification of the works or materials that have been violated; 3. the identification of the material that is believed to have been infringed including information regarding the location of the infringing material that the copyright owner requires is removed, with sufficient precision so that EPICO is able to find it and verify its existence ; 4. the contact information of the person sending the notification including the address, telephone number and, if available, the e-mail address; 5. a statement that the person sending the notification believes that the material has not been legally authorized by the copyright owner, its agent, or the law; and 6. a statement under oath that the information provided is accurate and that the notifying party has been authorized to make the complaint on behalf of the copyright owner.
5.3 Receipt of the Violation Notice
When the Designated Representative receives the Notice of Violation, EPICO's policy includes: 1. the removal or disabling of access to illegal material; 2. notification to the Content provider, member or user that access to the material has been removed or disabled; and 3. the communication that those who repeatedly violate the material will be removed from the system and that EPICO will interrupt the access of the Content provider, the member or the user to the service.
5.4 Procedure for sending a Response Notice to the Designated Representative
If the Content provider, member or user deems that the material that has been removed or whose access has been disabled is not illegitimate, or the Content provider, member or user believes to have the right to publish and use such material by the copyright owner , agent of the copyright owner, or pursuant to law, the owner of the Content, member or user must send a reply notification containing the following information to the Designated Representative: 1. A physical or electronic signature of the owner of the Content, member or user ; 2. Identification of the material that has been removed or whose access has been disabled and the location where the material appeared before being removed or disabled; 3. A statement that the owner of the Content, member or user has a good faith belief that material that has been removed or disabled due to error or misidentification of the material.
If the user contacts or initiates commercial relations with third parties in relation to the use of the EPICO Service, this activity exclusively concerns the user and the third party involved. EPICO will have no obligation or liability towards these activities. With this document, the user indemnifies and declares that EPICO is not responsible for any claim arising from this activity.
Except for Content submitted by members or users, the EPICO Service and all aspects related thereto, including all copyrights, trademarks and other intellectual property rights, are owned by EPICO. You acknowledge that the EPICO Service and any underlying technology or software used in connection with the EPICO Service contain information owned by EPICO. You may not modify, reproduce, distribute, create derivative works, publicly display or in any way exploit, any content, software and / or material available on the Website or EPICO Services in whole or in part except as expressly provided by the EPICO policies and procedures made available through the EPICO Service. Except as expressly provided for in this document, EPICO does not grant users any explicit or implicit rights, which remain the property of EPICO.
DISCLAIMER OF WARRANTIES
The Website is provided by EPICO "as is". EPICO and those who hold the license do not issue any type of guarantee expressed, legal or implicit regarding the operation of the Website and / or the EPICO Service, the software or information, content, materials or products included in EPICO or connected with EPICO Services. To the maximum extent permitted by law, EPICO and its licensees disclaim any express or implied warranty, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. Furthermore, EPICO and its licensees do not guarantee the accuracy or completeness of the information, texts, graphics, links or other elements contained on the Website or supplied with EPICO Services. EPICO is not responsible for the behavior of users of the Website. EPICO does not guarantee, endorse, or assume any responsibility for any product or service advertised or offered through the Website or EPICO Service or any other website or hyperlink present in any banner or other advertising and EPICO will not be responsible or in any way will have the task of monitoring every operation that takes place between users and third party suppliers of products or services. EPICO does not warrant that the EPICO Service will be available at any time or from any location, which will be safe or error-free, that defects will be corrected, or that the EPICO Service will be free of viruses or other potentially harmful components. Any material or content downloaded or otherwise obtained through the use of the EPICO Service is available at its own discretion and at your own risk and you will be solely responsible for any damage to your computer or loss of data resulting from downloading such material.
LIMITATIONS OF LIABILITY
EPICO is not responsible for the non-fulfillment of the aforementioned obligations, if such defaults derive from any cause beyond the reasonable control by EPICO, including, by way of example, mechanical, electronic or communication damages or deterioration. Notwithstanding the foregoing, EPICO shall not be liable for any indirect, incidental, punitive and consequential damages including, but not limited to, lost profits or business interruptions.
You agree to indemnify and release EPICO, its affiliates, affiliates, officers and employees, from any type of damage, including legal costs and expenses, arising from any claims or requests made by third parties due to or arising from ( i) access to the EPICO Website, (ii) the use of the EPICO Services, (iii) the violation by the user of the Terms of Service, or (iv) the violation by the user, or by third parties through the use of their account or user ID or password, any intellectual property rights or any other rights relating to person or entity.
EPICO, EPICO's registered trademarks relating to designs and / or images or photographs, the "www.epico.com" domain, are the property of eFanswer LTD. The user undertakes not to transmit or use these registered trademarks in any way without the prior written consent of EPICO.

VIDEO QUESTIONS: RELEASE TO USE IMAGE AND CONTENT
As registered member you accept to: 1. to grant to eFanswer LTD, with registered office in 55 London Road, St. Johns Wood, Londra N127JJ, P. IVA GB 205597305 (“eFanswer”) and to all its assignees, the full and perpetual right to use, record, film, duplicate, process, modify, reproduce, spread and publish – on any and all analogue, electronic, computer and/or digital support – image, voice and declarations made by means of audio/video recordings (hereinafter, the "Images"), for the purpose of: (i) including the video-questions of the users of the website https://www.epico.com within the digital book-interview (the “Social Biography”); and (ii) publishing the Images on the Company’s social network pages to promote the Social Biography; 2. to assign, free of charge, to eFanswer any right relating to, deriving from or in any way connected with the use and economic exploitation of the Images; 3. to warrant to eFanswer unhindered enjoyment of all the rights covered by this Release Form and to indemnify eFanswer and third parties against any claim and/or demand for compensation arising out of or in any way connected with this Release Form; 4. to be in no way entitled to claim for any reason or title from eFanswer, its transferees and/or assignees and/or in general from any person who uses the Images with reference to the object of the present Release Form and to irrevocably waive any right, action or claim in relation to the payment of fees or indemnities of any kind as a result of the provisions indicated above; 5. to provide my consent pursuant to Regulation (EU) 2016/679, as better detailed in the information on the processing of personal data set out in Annex A to this Release Form, which is an integral part hereof, to the processing and publication of my personal data in connection with the provisions of the present Release Form, granting eFanswer any right to indicate or not my personal data; 6. the present Release Form is governed by the law of The United Kingdom shall have exclusive and binding jurisdiction over any dispute regarding the content, interpretation, validity, effectiveness and/or execution of this Release. This Release Form does not allow the use of the Contents in any context that affects the personal integrity and decorum of the person portrayed or quoted according to this Release Form.
